PRIVACY POLICY

BASL / PRIVACY POLICY

The Bar Association of Sri Lanka (“BASL”, “us”, “we”, or “our”) owns and operates the BASL Mobile application (hereinafter referred to as the “App”).

This page informs you of our policies regarding the collection, use, and disclosure of personal data when you use the App and the choices you have associated with that data. The Personal Information that we collect are used for providing and improving the Service. We will not use or share your information with anyone except as described in this Privacy Policy.

We use your data to provide and improve the App. By using the App and features associated with it, you agree to the collection and use of information in accordance with this policy.

1.    Definitions

  1. App

App is the BASL Mobile App operated by The Bar Association of Sri Lanka.

  1. Personal Data

Personal Data means data about a living individual who can be identified from those data (or from those and other information either in our possession or likely to come into our possession).

  1. Log Data

Log Data is data collected automatically either generated by the use of the App or from the Service infrastructure itself.

  1. Cookies

Cookies are files with small amount of data that is commonly used an anonymous unique identifier.

  1. Information Collection and Use

We collect several different types of information for various purposes to provide and improve our App to you.

2.    Types of Data Collected

  • Personal Data

While using our App, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you (“Personal Data”). Personally identifiable information may include, but is not limited to your email address, full name, phone number, NIC/ Passport Number, BASL ID number, district, address, province, postal code.

  • Log Data

We may also collect information how the App is accessed and used (“Usage Data”). This Log Data may include information such as your device’s Internet Protocol address (e.g. IP address), browser type, browser version, the pages

of our App that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

  • Tracking & Cookies Data

Cookies are sent to your browser from an app or website and stored on your device. Other tracking technologies are also used such as beacons, tags and scripts to collect and track information and to improve and analyse our App. This App does not use cookies explicitly. However, the app may use third party code and libraries that use cookies to collect information and improve their services. You can instruct your device to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of our App.

3.    Use of Data

We may use the data collected in the following manner.

  • Name, gender, date of birth, telephone number, mobile phone number, E-mail address, connecting information (CI), duplication information (DI), password, Bank account information and mobile phone number information: to verify his/her identity for the use of our services, for communications to facilitate transactions, confirm his/her intent, provide services subject to age restrictions, handle complaints, to verify the destination for delivery of goods, give updates on services and notifications, to provide payment services, administering debt recoveries;
  • In the course of your using our services or transaction processing, the IP address, date and time of visit, records of use of our services may be automatically generated and collected to prevent unauthorized use and misuse.
  • Processing your orders and managing and administering your account.
  • To allow us to better service you in responding to your customer service requests.
  • Delivering any services, products or information requested by you;
  • To administer a contest, promotion, survey or other site feature.
  • To send periodic emails regarding BASL news, offers, products and services.
  • Verifying your identity when required (you may misplace your password or security information for example, and we may then need to request for other ‘identifiable’ information to protect your personal data from unauthorized access);
  • Undertake market and product analysis based on your use of our Products and/or Services (achieved by profiling your service preferences) and contact you with information on new developments, products, services and special offers by any means including but not limited to post, telephone and automated means such as mobile text message through Short Message Service (SMS), Email, Multimedia Message Service (MMS) and the world wide web or such other available methods;

4.    Transfer Of Data

  • Your information, including personal data, may be transferred to – and maintained on – computers located outside of your district, province, country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction.
    • If you are located outside Sri Lanka and choose to provide information to us, please note that we transfer the data, including personal data, to Sri Lanka and process it there.
    • Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.
    • BASL will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your personal data will take place to an organization or a country unless there are adequate controls in place including the security of your data and other personal information.

5.    Disclosure Of Data

BASL may in good faith disclose your personal data in the belief that such action is necessary to:

  • To respond to legal requirements, enforce our policies, respond to claims that a posting or other content violates other’s rights, or protect anyone’s rights, property, or safety;
  • Upon request of the Telecommunications Regulatory Commission of Sri Lanka, Central bank of Sri Lanka, Consumer Affairs Authority and/or other Government institution / agencies / authorities;
  • We employ and/ or use other companies and individuals to perform functions on our behalf. Examples include fulfilling orders, delivering packages, sending postal mail and e-mail, removing repetitive information from customer lists, analyzing data, providing marketing assistance, providing search results and links (including paid listings and links), processing credit card payments, and providing customer service. They have access to personal information needed to perform their functions, but may not use it for other purposes;
  • In the event that any division or product/service undergoes re-organization or are sold to a third party, your Personal Information we hold may be transferred to the re-organized entity or third party subject to the principles in this Privacy Policy;
  • To protect the interests of BASL.

6.    Security of Data

We value your trust in providing us your data, thus we are striving to use commercially acceptable means of protecting it. The security of your data is important to us but no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your personal data, we cannot guarantee its absolute security.

7.    Service Providers

We may employ third party companies and individuals to facilitate our Service (“Service Providers”), to provide the Service on our behalf, to perform Service- related services or to assist us in analysing how our Service is used. These third parties have access to your personal data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose. The App may also direct you to third-party apps or sites with internet payment gateways. We recommend that you read the privacy policy of these Service Providers prior to engaging in any monetary transactions. We are not responsible for any transactions that take place or any personal data that you may disclose to them.

8.    Analytics

We may use third-party Service Providers to monitor and analyze the use of our App.

9.    Links to Other Sites

Our App may contain links to other sites that are not operated by us. If you click a third party link, you will be directed to that third party’s site. We strongly advise you to review the Privacy Policy of every site you visit.

We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.

10. Children’s Privacy

Our Service does not address anyone under the age of 18 (“Children”).

We do not knowingly collect personally identifiable information from anyone under the age of 18. If you are a parent or guardian and you are aware that your Child has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from children without verification of parental consent, we take steps to remove that information from our servers.

11. Responsibilities of Users

  1. You have obligations to protect your own personal data, and we are in no event responsible for any issues or problems arising out of the leak of personal information caused by your own negligence (such as, transfer, lending or loss of your ID, Password, access medium, etc.), inherent problems in Internet (such as, vulnerability of browsers, hacking by use of such technology or method as cannot be prevented by security measures compliant with applicable laws and regulations and as controllable despite of substantial care taken by the Company to prevent the same) and the like, in each case, so long as it is not attributable to the Company.
  1. You should keep your personal data up-to-date, and are solely responsible for any accidents arising out of your provision of inaccurate information.
  1. If you misappropriate another’s personal information, when signing up for our services or entering into a transaction to sell or purchase goods or services, you may lose your membership and be subject to legal action.
  1. You are responsible to keep your ID, password etc. securely protected. You should not assign or lend any of them to a third party. You have obligations to cooperate with the Company’s request to change your passwords regularly for security purposes pursuant to the Policy.
  1. You must comply with all laws and regulations concerning personal information.

12. Delete or Deactivate Your Account.

If you want to delete or deactivate your account, you may do so by selecting the delete/ deactivate feature on the App. Merely uninstalling the App from your device does not guarantee the deletion or deactivation of your account.

13. Termination

The BASL may terminate this Privacy policy at any time. Without limiting the foregoing, we shall have the right to immediately terminate any passwords or

accounts of User in the event of any conduct by you which the BASL in its sole discretion, considers to be unacceptable, or in the event of any breach of this policy by you.

14. Changes to This Privacy Policy

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page.

We will let you know via email and/or a prominent notice on our App, prior to the change becoming effective and update the “effective date” at the top of this Privacy Policy.

You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
